Human Rights Month Quiz Competition Terms and Conditions – March 2019

  1. The Promoter is Legal Expenses Insurance Southern Africa Limited (LegalWise) (“the Promoter”), Registration number 1984/010574/06, a company incorporated in the Republic of South Africa and having its registered address at Block B, Constantia Ridge Office Park, 764 Golf Club Terrace, Constantia Kloof.
  2. The “HUMAN RIGHTS MONTH QUIZ COMPETITION” (“the Competition”) is open to any resident of South Africa 18 year or older who is, during the competition period set out in clause 4 below, a valid and active Facebook or Twitter user. Only one entry per person will be allowed, regardless of the chosen social media platform.
  3. The following persons are excluded from entering the Competition: Directors, members, partners, employees, agents OR consultants of the Promoter or any other person who directly or indirectly controls or is controlled by the Promoter, its marketing service providers in respect of the Competition, or the spouses, life partners, business partners or immediate family members of the aforementioned excluded persons.
  4. The Competition runs from 12:00 Friday 11 March 2019 until midnight on 31 March 2019.
  5. To enter the Competition and stand a chance to win a prize as set out in clause 7 below, the Entrant:
    1. Must be a South African resident and 18 years or older. Must be a valid and active Facebook or Twitter user. A valid profile will only have 1 chance to win and only one entry per person will be allowed, regardless of the chosen social media platform.
    2. Must click on the “send message” button on the competition ad that is served on Facebook or Twitter.
    3. Must complete all 4 quiz questions and answer all 4 quiz questions correctly.
    4. Cannot enter the Competition again after answering the 4 quiz questions correctly.
    5. Will be allowed to enter the Competition again if they did not answer the 4 quiz questions correctly. However, once they have answered the 4 quiz questions correctly, they cannot enter the Competition again.
  6. The Promoter reserves the right to remove any inappropriate/unsuitable content submitted for the Human Rights Month quiz.
  7. Winner and Prize
    1. The Win-Engine will randomly select 760 winners from the valid entries throughout the duration of the competion.
    2. The randomly selected winners will win a share of up to R100 in airtime. The airtime will be randomly distributed in denominations of between R5 and R100.
    3. The primary prize of the competition is airtime that will be allocated to the winners’ service provider based on the cell phone number used to enter the competition. Pre-paid users will immediately receive their airtime directly loaded to their phone.
    4. Contract users who cannot receive airtime, will receive a Checkers or Shoprite voucher in the same amount of the airtime they would have won (between R5 – R100). They will receive a voucher number that they can then redeem at their nearest Shoprite or Checkers store.
  8. The airtime/voucher is not transferable and not exchangeable for money.
  9. The Promoter shall have the right to terminate the Competition immediately and without notice for any reason beyond its control. In the event of such termination, all Entrants agree to waive any rights that they may have in terms of this Competition and acknowledge that they will have no recourse against the Promoter, its agents and/or staff.
  10. Participation in this Competition constitutes acceptance of the Competition’s rules and the Entrants agree to abide by these rules as set out herein.
  11. Except insofar as is provided for in the Consumer Protection Act 68 of 2008, the judges’ decision is final and no correspondence will be entered into after the Competition’s closing date.
  12. The Promoter and its affiliates will collect and use Entrants’ personal information provided, in order to enable the awarding of a Prize in this Competition. The Entrants’ personal information will furthermore also be used for the Promoter’s, its affiliates and subsidiaries’ marketing purposes in line with prevailing South African data retention and privacy legislation.
  13. By participating in the Competition, each Entrant consents to the transfer, storage and processing of their public and personal data in South Africa, which consent may be withdrawn at any time by written notification to the Promoter.
  14. The Promoter will keep the Entrants’ personal information to fulfil the purposes for which it was collected or as required by applicable laws or regulations. The Promoter will not use any of the personal information collected for a different purpose without first obtaining the data subject’s permission. The Promoter will not provide unauthorised third parties with the personal information collected during the Competition.
  15. All Entries become the property of the Promoter.
  16. By entering this Competition, the Entrants agree that the Promoter may contact them at any time during, or after, the Competition’s closing date, whereas the Winner/s may opt out from receiving such communication at any time.
  17. All Entrants indemnify the Promoter, its advertising agencies, advisers, suppliers, and nominated agents against any and all claims, damages or losses resulting from their participation in this Competition, arising from negligent acts or omissions of the Promoter.
  18. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries.
  19. The Promoter is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Promoter on account of technical problems, human error or traffic congestion on the internet or at any web site, or any combination thereof, including any injury or damage to Entrant's or any other person's hardware relating to or resulting from participation in this Competition or downloading any materials in this Competition.
  20. If required by the Minister of Trade and Industry, the National Consumer Commission or National Consumer Tribunal, or for any other reason whatsoever, the Promoter will be entitled to terminate the Competition immediately without any notice to the Entrants. In such an event all Participants hereby waive any rights which they may have against the Promoter.
  21. This Competition is in no way organised, endorsed- or administered by, or associated with Facebook or Twitter or any other social media forum.
  22. Any questions, comments or complaints regarding the Competition can be directed to the Promoter via e-mail: during office hours (between 8h00 AM and 16h30 PM, excluding public holidays and weekends) throughout the duration of the Competition.
