Driving meaningful contributions to South Africa's legal landscape.
Public participation is essential to a thriving democracy, giving individuals and organisations a voice in shaping the laws and policies that affect them. South Africa's Constitution reinforces this through principles of transparency, accountability, and public involvement across all levels of government.
For us, advancing access to justice means actively contributing to these processes. Through our Impact Litigation Unit, we have made written submissions on key matters affecting South Africa's future:
> Employment in the creative sector: Supporting proposals by the Department of Labour to recognise performers in advertising, artistic, and cultural activities as employees, a step that strengthens labour protections in the industry.
> Online gambling regulation: Providing input to the National Treasury on the Draft National Online Gambling Tax Discussion Paper, with a focus on addressing addiction and exploring global approaches to mitigating harm.
> Citizenship, immigration and identity management: Engaging with the Department of Home Affairs on the Draft Revised White Paper, highlighting the need for clearer legislative guidance on the blocking of identity documents to improve transparency and certainty.
> Online safety and digital harm: Contributing to the Draft White Paper on Audio and Audiovisual Media Services and Online Safety, with a focus on the growing risks of online harm, including technologically facilitated gender-based violence.
We are currently preparing submissions on the Draft South African National Artificial Intelligence Bill, focusing on digital safety, as well as the Protected Disclosures Bill 2026, which aims to strengthen protections for whistleblowers in both the public and private sectors. For us, public participation is more than a constitutional requirement, it is a powerful tool to drive meaningful change.
