Human Rights Day Campaign – 21 March 2020 T&Cs

  1. The Promoter is LegalWise South Africa (PTY) LTD an Authorised Financial Services Provider (FSP No. 50292) herein after referred to as (“Promoter”), Registration number 1999/003661/07, a company incorporated in the Republic of South Africa and having its registered address at Block B, Constantia Ridge Office Park, 231 Panaroma Drive, Constantia Kloof, Roodepoort, 1709.

  1. The “HUMAN RIGHTS DAY CAMPAIGN” (“the Campaign”) is open to members of the public who are not LegalWise Members (“Participant”) and who are 18 years of age or older, and who require legal advice.

  1. The purpose of the Campaign is to provide ONE FREE consultation on 21 March 2020 (Human Rights Day) per Participant (subject to clause 5 below). During the FREE consultation, the Participant will be allowed to ask legal advice on a matter, however, it will be limited to only one matter per Participant and consultation regardless of the amount or variety of matters that a Participant might have.

  1. The information given/obtained during the FREE consultation is aimed at providing the Participant with guidance on the law in South Africa. This information is once-off advice being provided and no further actions or assistance will follow or be allowed. This consultation, does not automatically constitute any relationship between yourself and LegalWise South Africa (PTY) LTD.

  1. The following persons are excluded from participating in the Campaign and will not be able to book a FREE consultation as per clause 5 below: 
    1. persons younger than 18 years of age;
    2. persons that require financial advice; and
    3. persons that require advice in respect of Intellectual Property and Tax related aspects.

  1. The Campaign will be available from 08:00 am on 2 March 2020 until 16:30 pm on 20 March 2020 (unless all appointments have been filled), during which Participants can book appointments for a consultation  on 21 March 2020:
    1. The consultations will only be available from 8:30 am until 15:00pm on 21 March 2020 and will be limited to a maximum of 45 minutes per consultation.
    2. Participants can book the consultation at one of our 34 Branches, which will have Legal Counsellors available to assist with providing legal advice as per clause 3 above.
    3. Consultations will be booked on a first-come-first-serve basis and will be scheduled for the next available slot. This means that Consultations cannot be booked as per a specifically requested timeslot.
    4. A Participant who wishes to participate in the Campaign is required to click on the “Book Now” button on the relevant post on Facebook. The Participant must then complete the requested form on Facebook and a LegalWise South Africa (PTY) LTD employee will contact the Participant to schedule the appointment for 21 March 2020. Participants will be contacted within 24 hours after completion of the form as referred to above and during office hours (between 8h00 AM and 16h00 PM, excluding weekends).

  1. The Promoter reserves the right to remove any inappropriate/unsuitable content submitted for the Human Rights Day Campaign.

  1. Transport to-and-from the LegalWise South Africa (PTY) LTD Office to attend the FREE Once-off consultation on 21 March 2020, is for your own account.    

  1. The Promoter reserves the right to terminate the Campaign immediately and without notice for any reason beyond its control. In the event of such termination, all Participants agree to waive any rights that they may have in terms of attending a FREE consultation at a LegalWise South Africa (PTY) LTD Branch and acknowledge that they will have no recourse against the Promoter, its agents and/or staff.

  1. Participation in this Campaign constitutes acceptance of the Campaign rules and the Participants agree to abide by these rules as set out herein.

  1. By participating in the Campaign, the Participant consents to the transfer, storage and processing of their public and personal data in South Africa, which consent may be withdrawn at any time by written notification to the Promoter.

  1. The Promoter will keep the Participants personal information to fulfill the purposes for which it was collected or as required by applicable laws or regulations. The Promoter will not use any of the personal information collected for a different purpose without first obtaining the data subject’s permission. The Promoter will not provide unauthorised third parties with the personal information collected during the Campaign.

  1. By showing interest in this Campaign, the Participants agree that the Promoter may contact them at any time during, or after, the Campaign’s closing date, whereas the Participant may opt out from receiving such communication at any time.

  1. All Participants indemnify the Promoter, its advertising agencies, advisers, suppliers, and nominated agents against any and all claims, damages or losses resulting from their participation in this Campaign, arising from negligent acts or omissions of The Promoter.

  1. The Promoter is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or request for an appointment to be received by the Promoter on account of technical problems, human error or traffic congestion on the internet or at any web site, or any combination thereof, including any injury or damage to the Participant or any other person's computer relating to or resulting from participation in this Campaign or downloading any materials in this Campaign.

  1. If required by the Minister of Trade and Industry, the National Consumer Commission or National Consumer Tribunal, or for any other reason whatsoever, the Promoter will be entitled to terminate the Campaign immediately without any notice to the Participants. In such an event all Participants hereby waive any rights which they may have against the Promoter.

  1. This Campaign is in no way organised-, endorsed- or administered by, or associated with Facebook or any other social media forum.

  1. Any questions, comments or complaints regarding the Campaign can be directed to the Promoter via the email socialmedia@legalwise.co.za during office hours (between 8h00 AM and 16h00 PM, excluding public holidays and weekends) throughout the duration of the Campaign.
