Vehicle accident procedures

What steps should you follow after a car crash?

A car accident can happen in the blink of an eye, leaving you disoriented and unsure of what to do next. To ensure you handle the situation effectively and safeguard your well-being, as well as any potential claims against a negligent driver, here are some essential steps to guide you through such a situation:

1.    Prioritise Safety and Check for Injuries:

Safety should be your top concern. If possible, move your vehicle to a safe spot, away from traffic. Turn on hazard lights and use cones or flares to warn other drivers. Stay calm and collected.

Before anything else, check yourself and your passengers for injuries. If anyone is hurt, immediately call for medical assistance.

2.    Exchange Information:

After ensuring everyone's safety and moving your vehicle away from potential danger, approach the other party involved in the collision, regardless of who was at fault. Leaving the scene of an accident is a criminal offense in South Africa.

Maintain a calm and respectful demeanor when communicating with the other party to avoid further complications. During this exchange, gather the following information:

>     Full name and Identity Number.

>     Physical Address and employment details.

>     License plate number.

>     Insurance details.

>     Contact information.

3.     Observe and Document the Scene:

In the age of smartphones, documenting the accident scene is easier than ever. Take photos of the damage to all vehicles involved, the surrounding area, and any relevant road signs or conditions. These photos will be crucial when determining the circumstances of the collision and liability.

If possible, make detailed notes of any important information that could support your innocence, as processes can be lengthy, and details can become hazy over time.

4.    Calling a Tow Truck:

Should you be insured, always arrange the assistance of a tow-truck through your insurer, or contact the service that is provided by them.  If not possible, or if you are not insured, always get a quote before releasing your vehicle and read all the information and fine print on any document before signing it.

Be very careful of hidden fees (especially daily storage rates) that might be stipulated and do not contract simply on the word of the driver.  Also write down the name, contact details, and vehicle registration number of the operator, driver and tow truck, and find out where your vehicle is being taken.

5.     Report the Accident:

Regardless of the accident's severity, it's crucial to call the police. Ideally, both parties should report to the nearest police station and complete an Accident Report. This report will contain invaluable details about the collision and can be used as evidence for insurance claims or legal action.

When providing information to the police, stick to the facts and make sure your account is clear and concise. Any indication of potential negligence on your part could negatively impact your claim.

6.     Notify Your Insurer:

If you're insured under a comprehensive plan and caused the accident, contact your insurance company to inform them of a potential claim. Keep in mind that if you claim for damages to your vehicle through your insurance, you can't later proceed with a claim against the other party, regardless of their negligence.
